Present: Senator Jennifer A. McEwen - Chair, Senator Gene Dornink, Senator Glenn H. Gruenhagen, Senator Robert J. Kupec, Senator John Marty, Senator Clare Oumou Verbeten, Senator Sandra L. Pappas, Senator Nathan Wesenberg

Absent: Senator Grant Hauschild - Vice Chair, Senator Bill Lieske

Senator Jennifer A. McEwen called the meeting to order at 12:39pm.

S.F. 1258: Senator Seeberger: Payment prohibition of certain sexual harassment or abuse settlements as severance.

Senator Judy Seeberger joined the witness stand to present Senate File 1258.

            Senator Seeberger offers the A-2 authors amendment.

 

The following witnesses testified in favor of passing S.F. 1258 as amended:

            Julie Risser, Minnesota resident

            Artik Roller, Executive Director, Minnesota Coalition Against Sexual Assault 

 

No witnesses offered testimony in opposition to S.F. 1258.

 

Senator John Marty moved to recommend S.F. 1258 for passage, and to re-refer it to the Senate Judiciary and Public Safety Committee.

            The motion carried along a voice vote.

 

Senator Marty moved that S.F. 1258, be recommended to pass and re-referred to the Judiciary and Public Safety Committee. - MOTION CARRIED.

S.F. 754: Senator McEwen: Building and Construction contracts requirements modification and clarification.

Chair Jennifer McEwen passed the gavel to Senator Clare Oumou Verbeten to preside.

 

Senator McEwen joined the witness stand and presented Senate File 754.

 

The following witnesses testified in favor of passing S.F 754:

            Patrick Lee O’Halloran, Counsel, Minnesota Subcontractors Association

            Tamara Sundby, owner, GTS HVAC

            Paulita LaPlante, owner, Prescription Landscape

 

The following witnesses testified in opposition to S.F. 754:

            Laura Ziegler, Director of Government Affairs, Associated General Contractors

            Patrick Hynes, Attorney, Messerli Kramer

            Jim Cownie, Deputy Chief Counsel, Minnesota Department of Transportation

            Cameron Boyd, General Counsel, Metropolitan Airport Commission

 

Patrick Lee O’Halloran rejoins the witness stand to answer questions from members.

 

Discussion.

 

Senator McEwen moved that S.F. 754 be recommended for passage and be re-referred to the Senate Judiciary and Public Safety Committee.

            The motion passed on a voice vote. 

 

Senator McEwen moved that S.F. 754, be recommended to pass and re-referred to the Judiciary and Public Safety Committee. - MOTION CARRIED.

S.F. 1384: Senator McEwen: Occupational Safety and Health Act citation data classification.

Senator McEwen presented Senate File 1384.

 

The following witnesses testified in favor of passing S.F. 1384:

            Jim Krueger, Director of Minnesota Occupational Safety and Health Administration

Paul Aasen, President of the Minnesota Safety Council

Adam Duininck, Director of Government Affairs, North Central States Regional Council of Carpenters

 

The following witness testified in opposition to S.F. 1384:

            Jon Boesche, Director of Government Affairs, Associated Builders and Contractors of Minnesota & North

            Dakota.

 

Jim Krueger re-joined the witness stand to answer member questions.

 

Discussion.

 

Senator Glenn Gruenhagen offered the A-4 amendment.

            Senator Gruenhagen requested a roll call vote.

 

The following Senators voted in favor of adopting the A-4 amendment:

Senator Dornink, Senator Gruenhagen, Senator Wesenberg.

 

The following Senators voted against adoption of the A-4 amendment:

Senator Oumou Verbeten, Senator Kupec, Senator Marty, Senator McEwen, Senator Pappas.

 

There being 3 votes in favor, 5 votes against the A-4 amendment was not adopted, Senators Hauschild & Lieske absent.

 

Senator Gruenhagen offered the A-3 amendment.

            Senator Gruenhagen withdrew the A-3 amendment.

 

Senator McEwen moved that S.F. 1384 be recommended for passage and re-referred to the Senate Judiciary and Public Safety Committee.

            The motion passed along a voice vote.

 

Senator McEwen moved that S.F. 1384, be recommended to pass and re-referred to the Judiciary and Public Safety Committee. - MOTION CARRIED.
