Present: Senator Jennifer A. McEwen - Chair, Senator Grant Hauschild - Vice Chair, Senator Gene Dornink, Senator Glenn H. Gruenhagen, Senator Robert J. Kupec, Senator Bill Lieske, Senator John Marty, Senator Clare Oumou Verbeten, Senator Sandra L. Pappas, Senator Nathan Wesenberg

Absent: No Members Absent

Senator Jennifer A. McEwen called the meeting to order at 12:39.

S.F. 405: Senator Mann: Provision that covenants not to compete are void and unenforceable.

Senator Alice Mann joined the witness stand to present S.F. 405.

            Senator Mann introduced the A-2 authors amendment.

            Senator Clare Oumou Verbeten moved to adopt the A-2 amendment.

            The motion carried on a voice vote.

The following witnesses testified in favor of passing S.F. 405 as amended:

            Dr. Hannah Lichtsinn, Minneapolis via Zoom.

            Kevin Borowske, member of SEIU Local 26.

 

The following witnesses testified against passing S.F. 405 as amended:

            Kurt Erickson, lawyer at Littler Mendelson P.C.

 

Discussion.

 

Senator Gene Dornink requested a roll call vote.

            Senator Bill Lieske requested the roll call vote be recorded in the Senate Journal.

 

Senator Oumou Verbeten moved to recommend S.F. 405 as amended and be re-referred to the Senate Committee on Judiciary and Public Safety.

 

The following Senators voted to recommend and re-refer S.F. 405:

Senator McEwen, Senator Hauschild, Senator Kupec, Senator Oumou Verbeten, Senator Pappas.

 

The following Senators voted against recommendation and re-referral of S.F. 405:

Senator Dornink, Senator Gruenhagen, Senator Lieske, Senator Wesenberg.

 

The motion carries on a vote of 5 in favor, to 4 opposed. Senator Marty absent.


S.F. 405 is recommended to pass and is re-referred to the Senate Committee on Judiciary and Public Safety.

 

Senator Oumou Verbeten moved that S.F. 405, as amended, recommended to pass and re-referred to the Judiciary and Public Safety Committee. - MOTION CARRIED.
