|
SF 3181 allows for an update of benefits determined for a drainage system using current estimated market values for the purpose of a “forced” drainage repair. Under clause (2), a drainage system can be petitioned for repair by 26 percent of the property owners based on the fact that the “system is in need of repair.” If the repair does not exceed the recorded benefits, the drainage authority must conduct the repair. A repair may also be ordered by the drainage authority under clause (1) without cost limitation as long as the repair is “for the best interests of the property owners.”
