Section 1 [Quarterly MNLARS Funding Review].  The Legislative Advisory Committee (LAC) is required to conduct quarterly reviews of MNLARS progress before the next quarter’s funding is allotted.

Subdivision 1 [Definitions].  Provides definitions.

Subdivision 2 [Establishing system benchmarks].  Requires the commissioners of Public Safety and MN.IT to submit to the LAC, by May 15, a proposed progress timeline for the development and implementation of MNLARS. By June 1, the LAC, in consultation with the commissioners, must approve a timeline, including quarterly system benchmarks that must be met.

Subdivision 3 [Review of MNLARS appropriation].  Funds appropriated to the Department of Public Safety (DPS) are divided into four equal quarterly payments, to be allotted as provided in this section. Twenty days before the next quarter starts, the commissioner of Minnesota Management and Budget (MMB) must submit the proposed funding allotment to the LAC. The LAC has 20 days to determine whether DPS has met the system benchmarks. If any member of the LAC makes a negative recommendation or recommends further review, the commissioner must not allot the quarterly funds for the next quarter. If all of the members of the LAC make a positive recommendation or no recommendation, the commissioner of MMB may allot the next quarterly funds. A member may withdraw a negative recommendation or a recommendation for further review; if all such recommendations are withdrawn, the commissioner may allot the quarterly funds.  A commission recommendation must be at a commission meeting unless all members sign a written recommendation.

Subdivision 4 [Resubmission of proposal].  If an allotment is not made, the commissioner of MMB may submit proposed legislation to the Finance and Ways and Means chairs to be considered in the 2019 session.

This section is effective the day following final enactment and applies to any fiscal year 2019 appropriations for MNLARS.

Section 2 [Appropriations].  Appropriates $7.3 million from the special revenue fund in fiscal year 2018 to DPS for contracted technical staff and technical costs related to MNLARS. Of this amount, $2 million is from the vehicle services operating account and $5.3 million is from the driver services operating account.
