This bill modifies requirements regarding law enforcement use of an automated license plate reader (ALPR).
Section 1 reorganizes the elements of the log that must be maintained for each period of active use of an ALPR. Most of the elements are included in current law. In addition, under item (iii), a reference to a canceled driver’s license is added.
Section 2 amends the biennial audit requirements. The audit must be conducted by an independent auditing firm that is not a law enforcement agency. In addition, the report required under current law that must be provided to the commissioner of administration and the legislature must be submitted by July 1 of each odd-numbered year. Information that must be included in the audit is specified.
Section 3 clarifies the notification that must be given to the Bureau of Criminal Apprehension regarding the use of an ALPR. The date that an agency first began acquiring or using the technology must be included.
