Background: The Pollution Control Agency recently announced that it plans to amend its water quality fee rules because the fees the agency currently charges for water-related permitting only cover 17% of the cost of delivering the associated programs.

Minnesota Statutes section 16A.1283 prohibits agencies from imposing new fees or raising existing fees until the legislature approves of the new fee or increase. 

Bill Summary: SF 2637 clarifies that MS 16A.1283 applies to any increase by the Pollution Control Agency of the following fees related to water quality:

  • Fee for training water pollution control personnel (MS 115.03, subd. 1, paragraph (j))
  • Fee for training subsurface sewage treatment system personnel (MS 115.03, subd. 1, paragraph (n))
  • Fee for wastewater & water supply system operator certification (MS 115.77, subd. 1)
  • Fee for wastewater laboratory certification (MS 115.84, subd. 3)
  • Water-related permit fees (MS 116.07, subd. 4d)
