Section 1 [Merchant bags] prohibits local governments from adopting ordinances that would ban merchants from providing customers paper, plastic, or reusable bags. It also prohibits a local government from imposing a fee or tax on merchant-provided bags.

The effective date is May 31, 2017 and invalidates any ordinance enacted before the effective date.

Section 2 [Appropriation; plastic bags recycling pilot project] appropriates $20,000 from the environmental fund to the Pollution Control Agency for grants to local units of government for plastic bag recycling pilot projects.  Two of the grants will be for local units of government in urban areas, and two for local units of government in rural areas.
