Section 1 includes a cross-reference in the Data Practices Act to the data classification in section 2.

Section 2 establishes a process under which an individual can make an anatomical gift as part of an online application for a fishing or hunting license.

Paragraph (a) requires applications through the DNR online sales system to allow the applicant to indicate a desire to make an anatomical gift.

Paragraph (b) requires the system to contain statements sufficient to comply with the requirements of the law governing anatomical gifts, so that execution of the application would make the gift effective.  The department Web site must provide a link to a federally designated organ procurement organization that contains information regarding anatomical gift laws, the need for and benefits of gifts, and legal implications.

Paragraph (c) requires the commissioner to provide education by distributing information regarding organ and tissue donation and how to register as a donor.  The information must be distributed through print and digital communications targeting those who hunt and fish and must be prepared in conjunction with an organ procurement organization.

Paragraph (d) provides that the commissioner is not required to keep the physical record of the application for the anatomical gift to be valid.  If an individual indicates consent to share private data for the record of registered donors, the commissioner must provide the private name and address of the individual to an organ procurement organization.  The names and addresses are classified as private data and remain private once provided to the organ procurement organization.

Paragraph (e) provides that the general law applicable to anatomical gifts would apply to those made on an application under this section.

Paragraph (f) provides for reimbursement of the department from the anatomical gift account for reasonable costs of administering the program.

Section 3 amends the anatomical gift account in the special revenue fund to provide for reimbursement to state agencies for administering costs incurred in implementing an anatomical gift and donation program.

Section 4 requires an interim report by January 1, 2018, from the Commissioner of Natural Resources to legislative Natural Resources policy committees concerning implementation of this act.

Sections 1 to 3 are effective March 1, 2017.
