This bill specifies requirements on background checks for driving instructors. Among the provisions, it:

  • requires the Department of Public Safety to conduct a check before issuing an instructor license;
  • permits subsequent background checks of individuals who hold an instructor license;
  • specifies that state criminal history and driver’s license records, as well as national criminal history records, are to be checked;  
  • provides for application processing and acceptance of fees;
  • directs the superintendent of the Bureau of Criminal Apprehension to undertake the checks, including sharing fingerprint information with the Federal Bureau of Investigation (as part of checking the national criminal history records);
  • permits issuance of a temporary 180-day instructor license, if the applicant provides an affidavit concerning no past convictions and background check information from all past states of residence; and
  • permits reissuance of a temporary license if there is a delay in receiving national background check results.
