S.F. No. 2694 - Supermajority Required to Impose Interim Ordinance in City or Town

Author: Senator Melisa López Franzen

Prepared By: Alexis C. Stangl, Senate Counsel (651/296-4397)

Date: April 4, 2016

Section 1 requires a two-thirds vote of all members of the city council or town board to adopt an interim ordinance. (An interim ordinance is often referred to as a moratorium.) If a proposed interim ordinance regulates, restricts, or prohibits activities relating to housing, a public hearing must be held. A public hearing must be held following a 30-day published notice before the interim ordinance may take effect. This section is effective on August 1 and applies to interim ordinances proposed on or after that date.
