S.F. No. 1857 - Changing and Updating Certain Claims Provisions (Delete-Everything Amendment)

Author: Senator Barbara Goodwin

Prepared By: Chris Turner, Senate Fiscal Analyst (651/296-4350)

Date: April 1, 2016

Section 1 is a technical amendment referencing the new statutory language created in section 2 of the bill.

Section 2 authorizes the Commissioners of Human Services, Veterans Affairs, or Corrections to determine and settle loss or damage of property claims upon the state of $7,000 or less without going through the claims committee process.

Section 3 authorizes the Commissioner of Corrections to determine and settle claims of injury or death of conditionally released inmates of $7,000 or less.  Claims greater than $7,000 must be settled through the claims committee process.  The current floor for claims filed by conditionally released inmates is $500.

Under current law, claims for injury or death of inmates under direct supervision of the Commissioner of Corrections are governed by section 3.732, subdivision 2, the generic claims floor of $7,000.

Section 4 increases the claims committee filing fee from $5 to $8.

Section 5 provides a July 1, 2016, effective date.
