SF 1474 modifies the licensure requirement for body art applicants and clarifies the required documentation needed before a technician may perform a body piercing on an individual under the age of 18.

Section 1 (146B.01, subd. 28) distinguishes in the definition of supervision that there is direct supervision and indirect supervision and specifically defines both.

Section 2 (146B.03, subd. 4) modifies the licensure requirements for a body art technician beginning January 1, 2017, to require an applicant to submit:

1. proof that the applicant is over the age of 18;
2. the type of license applying for;
3. all required fees;
4. a log showing the completion of the required supervised experience that includes a list of each licensed technician who provided the required supervision;
5. a signed affidavit from each licensed technician who is listed by the applicant;
6. proof of satisfactorily completing a minimum of five hours of required coursework within one year preceding application and approval by the commissioner; and
7. any other relevant information requested by the commissioner.

Section 3 (146B.03, subd. 6) requires the commissioner to notify the technician 60 days before the technician’s license expires.

Section 4 (146B.03, subd. 7) makes a corresponding technical change.

Section 5 (146B.03, subd. 12) specifies the number of supervised hours an applicant must complete for a tattoo technician license, a body piercing technician, and a dual body art technician license.

Section 6 (146B.07, subd. 1) specifies that a technician must require proof of age from clients who state that they are 18 years of age or older.

Section 7 (146B.07, subd. 2) clarifies that a technician may not perform body piercings on an individual who is under the age of 18 unless the individual’s parent or guardian provides identification by using one of the described methods and provides documentation that reasonably establishes that the individual is the parent or guardian of the individual who is seeking the body piercing; and the individual seeking the body piercing provides proof of identification by one of the described methods.
