Section 1 [144.586] Subdivision 1 requires hospitals to provide notice to patients they place on observation status that Medicare may not cover (1) hospital services, or (2) upon discharge, home and community-based care or care provided at a skilled nursing facility.

Subdivision 2 requires hospitals to provide discharge planning that complies with federal hospital requirements.

Section 2 (144D.06) retains language that all housing with services establishments are subject to Minnesota Statutes, chapter 504B, which is the landlord and tenant chapter of law. It also clarifies that after August 1, 2015, those housing with services establishments with special care units, which care for people with Alzheimer’s disease and other dementias, are subject to chapter 157, which is the lodging establishment chapter of law, but housing with services establishments without special care units are not subject to chapter 157.

Section 2 also requires the commissioner to submit a report by January 15, 2016, recommending any additional regulations required to protect people with dementia residing in special care units of housing with services establishments.
