SF 1765 makes several changes to the Board of Pharmacy chapter.

Section 1 (151.01, subd. 15a) modifies the definition of a pharmacy technician to state that a physician technician means a person who is not a licensed pharmacist or a registered pharmacist intern who has been trained in pharmacy tasks that does not require professional judgment of a licensed pharmacist.  A pharmacy technician may not perform tasks specifically reserved to a licensed pharmacist.

Section 2 (151.01, subd. 27) authorizes a pharmacist to participate in the administration of influenza vaccines to eligible individuals who are six years of age or older (currently the age is ten or older); the administration of a booster dose or the completion of a vaccine series to individuals 13 years of age to 17 years of age that does not include the initial dose of a vaccine; and all other vaccines to individuals who are 18 years of age or older.   Requires the pharmacist to utilize the Minnesota Immunization Information Connection to assess the immunization status of the individual before administering vaccines, except when administering influenza vaccines to individuals who are nine years of age or older.

Section 3 (151.02) increases the number of members on the State Board of Pharmacy to three public members (currently there are two public members), and six pharmacists (currently there are five pharmacists).

Section 4 (151.102) modifies the scope of practice of a pharmacy technician to authorize a technician to perform tasks that are not reserved to and do not require the professional judgment of a licensed pharmacist.  This section also increases the number of pharmacy technicians that a licensed pharmacist may supervise from up to two technicians to up to three technicians.  It also authorizes the board to set ratios of technicians to pharmacists that are greater than three to one for functions that are specified in rule.

Section 5 (151.48, subd. 2) adds to the definition of a “health care facility” for purposes of permitting an automated drug distribution system within the facility a licensed board and care home that is providing centralized storage of medications.
