S. F No. 1416 allows local governments to donate surplus equipment to nonprofit organizations.
Section 1 provides an exception to tort liability for municipalities that donate surplus equipment under this section.
Section 2 defines local government to mean counties, cities, town, instrumentalities of these; special districts; and joint power boards. Surplus equipment is defined to mean public safety equipment, public works equipment, cell phones, and emergency medical and firefighting equipment that is no longer needed because it does not meet industry standards or has minimal or no resale value. Before a local government may make a donation, it must adopt a policy on how it will determine what equipment may be donated and how it will determine to which nonprofit the donation will be made.
