This bill amends the chapter of law governing building and construction contracts. Current law limits the enforceability of certain indemnification agreements and agreements to insure.
Section 1 amends the definition of “indemnification agreement” to include an agreement to defend against liability for damages. Current law only refers to an agreement to indemnify or hold harmless.
Section 2 amends the statute dealing with the validity of agreements to insure. A reference to project-specific insurance in the types of provisions that wouldn’t be void is striken.
Section 3 contains an immediate effective date and provides that section 1 and 2 apply to agreements entered into on or after that date.
