Author: Senator Julie A. Rosen

Prepared By: Kenneth P. Backhus, Senate Counsel (651/296-4396)

Date: March 11, 2015

Section 1 amends the law defining Schedule I drugs. Schedule I drugs are drugs that have high potential for abuse, no currently accepted medical use in the United States, and a lack of accepted safety for use under medical supervision. Adds a number of synthetic drugs to Schedule I.

Section 2 amends the law defining Schedule II drugs. Schedule II drugs have a high potential for abuse, currently accepted medical use in the United States or currently accepted medical use with severe restrictions, and abuse may lead to severe psychological or physical dependence. Adds drugs to the Schedule II list. These drugs  are already listed as federal Schedule II drugs. Thus, these changes conform Minnesota’s Schedule II list to the federal Schedule II list.

Section 3 amends the law defining Schedule III drugs. Schedule III drugs have a potential for abuse less than the substances listed in Schedules I and II, currently accepted medical use in treatment in the United States, and abuse may lead to moderate or low physical dependence or high psychological dependence. Strikes language and adds drugs to the Schedule III list. These changes conform Minnesota’s Schedule III list to the federal Schedule III list.

Section 4 amends the law defining Schedule IV drugs. Schedule IV drugs have a low potential for abuse relative to the substances in Schedule III, currently accepted medical use in treatment in the United States, and abuse may lead to limited physical dependence or psychological dependence relative to the substances in Schedule III. Adds drugs to the Schedule IV list. These drugs are already listed as federal Schedule IV drugs. Thus, these changes conform Minnesota’s Schedule IV list to the federal Schedule IV list.

Section 5 amends the law defining Schedule V drugs. Schedule V drugs have a low potential for abuse relative to the substances listed in Schedule IV, currently accepted medical use in treatment in the United States, and limited physical dependence and/or psychological dependence liability relative to the substances listed in Schedule IV. Adds drugs to the Schedule V list. These drugs are already listed as federal Schedule V drugs. Thus, these changes conform Minnesota’s Schedule V list to the federal Schedule V list.
