S.F. No. 760 - Juvenile Delinquency Continuance Without Adjudication Time Extension

Author: Senator Bobby Joe Champion

Prepared By: Chris Turner, Senate Fiscal Analyst (651/296-4350)

Date: March 5, 2014

The bill allows the court, with the approval of the prosecutor, to continue a juvenile delinquency case for up to 180 days.  Current law allows continuances of up to 90 days and does not require the approval of the prosecution. The bill also expands the circumstances in which the court may enter an order during the continuance under Minnesota Statutes, section 260B.198, to include all cases that do not involve out-of-home placement of the child or the commitment of the child to the Commissioner of Corrections.

The bill is effective August 1, 2013, and applies to continuances ordered by the court on or after that date.
