Section 1 [Definitions] adds definitions of "school employee" and "school employer" for purposes of the bill. Also includes a state affiliate of an exclusive representative of employees as an eligible employer.

Section 2 [Public Employee Participation] allows school employer that makes available health insurance coverage for employees to do so through PEIP, beginning January 1, 2014, as contracts in place upon enactment expire.  School districts that opt out are ineligible to participate for four years and may be pooled and rated separately from other employees if they subsequently enter the program. A decision not to opt out is irrevocable.

Section 3 [Nonidentifiable Aggregate Claims Data From Past Coverage] requires entities that have been providing coverage to school employees to provide nonidentifiable aggregate claims data to the commissioner.

Section 4 [Start-up Funding] requires the commissioner to use funds in the insurance industry trust fund to pay the administrative costs for start-up and to provide necessary reserves.  The insurance trust fund will be repaid by an enrollment fee the commissioner is required to charge on the premium for the first three months of coverage under the school employee insurance plan.

Section 5 [Labor-Management Committee for School Employees and School Employers] establishes a Labor-Management Committee for school employees and school employers.

Section 6 [Repealer] repeals a law that established a  Labor-Management Committee under PEIP.  This committee has never been active.
