Section 1 [325F.174] [Bisphenol-A in Children’s Food Containers]
Subdivision 1 [Prohibition] beginning January 1, 2014, prohibits manufacturers or wholesalers from knowingly selling or offering for sale food containers containing Bisphenol-A in Minnesota. Beginning January 1, 2015, prohibits retailers from knowingly selling or offering food containers containing Bisphenol-A in Minnesota.
Subdivision 2 [Definitions] provides definitions for “children’s food” and “container.” “Children’s food” applies to commercially available food or liquid to be consumed by a 12 year-old or younger.
Section 2 [325F.175] [Bisphenol-A replacement chemicals] prohibits a manufacturer from replacing Bisphenol-A in children’s food containers with a chemical known to the manufacture to have been identified by a state, federal, or international agency as being known or suspected to: (1) harm the normal development of a fetus or child; (2) cause cancer, genetic damage, or reproductive harm; (3) disrupt the endocrine or hormone system; or (4) damage the nervous system, immune system, or organs. Makes this section effective August 1, 2013, and applies to crimes committed on or after that date.
