Section 1 amends the parenting time statute to increase the rebuttable presumption of parenting time to which a parent is entitled from 25 to 35 percent.

Section 2 amends the calculation of the parenting expense adjustment for purposes of determining child support.  The current 12 percent adjustment is increased to 15 percent and it would apply in cases where the range of parenting time is 10 percent to 30 percent (instead of 45 percent).  A new parenting time adjustment is included for parenting time in the range of 30.1 percent to 45 percent, which would be a 35 percent adjustment.

Section 3 contains the effective date and application provisions.  Sections 1 and 2 would be effective January 1, 2013, and apply to orders adopted or modified on or after that date.  There must be no modification of a parenting time or child support order adopted before the effective date based solely on the amendments contained in sections 1 and 2.
