S.F. No. 2316 - Veterans preference removal hearing board appointment procedure modification

Author: Senator Doug Magnus

Prepared By: Stephanie James, Senate Counsel (651/296-0103)

Date: March 12, 2012

Section 1 [Veterans Preference Act; Removal Forbidden; Right of Mandamus] requires that when certain government subdivisions notify an employee who is a veteran of an intent to discharge the veteran from employment, the subdivision must state that the veteran has 60 days to identify and provide contact information about the person who will represent the veteran before a three-person board hearing the veteran’s complaint about the discharge.  A failure of the veteran to provide the information within 60 days constitutes a waiver of the veteran’s right to the hearing and all other legal remedies available for reinstatement of the veteran’s employment position.

This section grants governmental subdivisions the right to appeal a decision of the board on a veteran’s complaint about discharge from employment.
