Author: Senator David M. Brown

Prepared By: Christopher B. Stang, Senate Counsel (651/296-0539)

Date: March 1, 2012

Sections 1 and 2 are conforming changes related to the new definition of travel insurance in section 3.

Section 3, subdivision 1 provides definitions for purposes of the section.

Subdivision 2 establishes requirements for a travel retailer to offer travel insurance on behalf of, and under a travel insurance producer business entity license. The licensed business entity must be identified as the licensed producer on marketing materials, keep a register of travel retailers that offer travel insurance on the business entity's behalf, designate an employee as a "designated responsible producer" responsible for complying with insurance laws, and require employees of the travel retailer to receive training.

Subdivision 3 allows a travel retailer to receive compensation when offering travel insurance under the requirements of this section.

Subdivision 4 makes the travel insurance producer responsible for the acts of the travel retailer.

Section 4 provides for effective dates.
