Prepared By: Kathleen Pontius, Senate Counsel (651/296-4394)

This bill amends the in forma pauperis statute, which allows individuals who are financially unable to pay court fees and costs to have payment of fees and costs waived by the court.  If the party is or becomes able to pay all or a portion of the fees and costs, the court may order payment of a fee of  $75 or reimbursement or partial payment of all or a portion of those amounts, to be paid as directed by the court.  Any fees or payments made must be transmitted by the court administrator to the Commissioner of Management and Budget for deposit in the State Treasury and credit to the General Fund.  A July 1, 2011, effective date is included.
