Section 1, subdivision 3 [Professional athletes] provides that this section should not be construed to interfere with the operation of a drug and alcohol testing program in the workplace,  and specifically Minnesota Statutes, sections 181.950 (definitions); 181.951 (authorized testing); 181.952 (policy and notice); 181.953 (reliability and fairness safeguards); and 181.954 (privacy, confidentiality, and privilege safeguards),  if the program is permitted under a contract covering professional athlete employees.  Requires, under the Commissioner's request, the exclusive representative and the employer to certify that the program under contract should operate without interference from the requirements of sections 181.950 to 181.954.
