S.F. No. 1199 - Prevailing Wage Provisions Modifications

Author: Senator John C. Pederson

Prepared By: Carlon D. Fontaine, Senate Counsel (651/296-4395)

Date: April 5, 2012

Section 1, subdivision 4 [Prevailing hours of labor] modifies the definition of “prevailing hours of labor” by changing the prevailing hours of labor to ten hours per day or 40 hours per week for work performed Monday through Saturday for purposes of overtime pay.  Currently, the prevailing hours of labor contain a daily maximum of eight hours per day in addition to the 40 hour per week limit.

Section 2, subdivision 7 [Applicability] increases the project threshold amount requiring payment of prevailing wages from $25,000 to $500,000, and eliminates the two tier system (distinguishing between projects that involve one or more trade), so that the same threshold applies to all projects.  Requires the commissioner to annually adjust the project threshold amount according to the Producer Price Index.
