S.F. No. 534 - Arrest Authorization For Juveniles Alleged or Adjudicated Delinquent Who Escape From Custody

The bill adds gross misdemeanor violations of Escape from Custody (Minnesota Statutes, section 609.485) to the statute authorizing peace officers to arrest an individual without a warrant. Currently, juveniles committed to the Commissioner of Corrections or court ordered to Minnesota Correctional Facility-Red Wing have gross misdemeanor warrants issued for their arrest if they escape from custody on furlough status. Officers are prohibited from entering a home without permission on a gross misdemeanor warrant unless they are in fresh pursuit. This change will provide law enforcement authority to enter absent permission and execute the arrest.

The bill is effective August 1, 2009.
