Section 1 amends the definition of "chemically dependent person" under the civil commitment law to include a pregnant woman who has engaged during the pregnancy in habitual or excessive use, for a nonmedical purpose, of tetrahydrocannabinol or alcohol. Current law is limited to the use of specified controlled substances.

Section 2 amends the mandatory reporting law for prenatal exposure to controlled substances to add the use of tetrahydrocannabinol or consumption of alcoholic beverages during pregnancy in a way that is habitual or excessive.

Section 3 makes a conforming change in the responsibilities of the local welfare agency, consistent with the expansion of the reporting requirements.

Section 4 repeals the definition of a "controlled substance" under the reporting law.
