The proposed legislation provides that if a county through its social service agency or other
county authority removes a child from its parental home and the removal is found by district court
to be inappropriate, the county is liable for all the costs related to the removal, including attorney
fees and other legal costs of the parents, and the costs of care for the child while in county control
during the period of removal. Before such a finding could be made, a hearing in a district court
where the county, parents, other interested parties, and witnesses may be heard must be held.
