Under current law, an appeal for a variance from the Uniform Fire Code cannot be accepted
by the state fire marshal until the applicant has applied to the local governing body and the local unit
has acted on the application.
The bill allows direct appeal to the fire marshal who is only obligated to consider any decision or recommendation that may have been made by the local governing body.
