S.F. No. 239 - Making Collection of Biological Specimens from Offenders for Future DNA Analysis Permanent

Minnesota law (Minnesota Statutes, section 609.117) requires the collection of biological specimens from certain felony offenders for DNA analysis at the time of sentencing, release from incarceration, or acceptance for supervision from another state under the interstate compact on adult probationers and parolees. The 2002 Legislature expanded this requirement for a one-year period to require collection of specimens for all felony offenders. (This was codified at Minnesota Statutes, section 609.119.) Of note, however, this expansion only required the collection of specimens, not their testing. Testing was to occur at a later date when funding became available. S.F. No. 239 makes the expanded collection requirement permanent so that these specimens will continue to be collected for all felony offenders for future analysis.
