The proposed special legislation would correct an error relating to the local approval of a special law enacted for these two jurisdictions in 1995 dealing with the human resources functions of the two agencies. The 1995 law authorized the two bodies to adopt resolutions declaring that the human resources functions of the two would be more efficiently and effectively administered separately, and the law contained a local approval clause, which required approval by the two governing bodies and filing the certificates of approval with the Secretary of State. The approval by the governing bodies was done on December 19, 1995, by the school district and on January 10, 1996, by the St. Paul City Council, but the certificates of the local approval were not filed timely with the Secretary of State. This legislation would correct that defect and provide that the 1995 law was nonetheless effective and that any actions taken under it are validated. The 1995 legislation was enabling legislation and, as such, local approval was not required even though a local approval provision was contained in the law. This bill is identical to S.F. No. 3189, which passed out of this committee on February 22, 2002, and passed the full Senate on May 18, 2002, 63 to 0, but the companion House file died on the House floor.
