S.F. No. 179 - Licensure for Denturists - Judiciary Issues

This bill establishes a system of licensure for denturists. Following is a summary of the judiciary issues.

Article 1, section 13, contains provisions dealing with grounds for disciplinary action and suspension of a license.

Subdivision 3 authorizes the Commissioner to issue subpoenas and compel the attendance of witnesses and the production of documents in connection with investigations against licensees. The Commissioner may apply to the district court for an order to comply with an order or subpoena. The Commissioner is also authorized to administer oaths and take depositions.

Subdivision 4 contains provisions authorizing the Commissioner to temporarily suspend the right of a denturist to practice under certain conditions. The procedures for imposing a suspension are specified.

Section 15 contains reporting obligations for persons who have knowledge of conduct that would constitute grounds for disciplinary action. Permissive and mandatory reporting provisions are included.

Section 16 requires a denturist who is the subject of an investigation to cooperate fully. The Commissioner must establish internal operating procedures for exchanging information and coordinating investigations and for the exchange of information with other states regarding disciplinary action. Special data provisions are included.

Article 2, section 2, amends the medical records statute to add denturists to the definition of a provider.

Section 4 amends the professional firm statute to authorize denturists to provide professional services in combination with dentists under certain circumstances.
