This bill adds special disclosure provisions regarding whether real property is located in a special well construction area that must be complied with before entering into a purchase agreement in Washington County. These are areas in which the Department of Health has determined that the groundwater is contaminated, which creates a need for special precautions for constructing and using wells.

Section 1 provides that before signing an agreement to sell or transfer real property in Washington County that is not served by a municipal water system, the seller must provide a written statement to the buyer as to whether, in the seller's knowledge, the property is located within a special well construction area. If the general disclosure under the law with respect to unsealed wells is required, the disclosure under this new provision must be made regardless of whether the property is served by a municipal water system.

Section 2 contains an effective date of January 1, 2004. The bill would apply to transactions for which purchase agreements are entered into on or after that date.
