S.F. No. 143 - Omnibus Liquor Bill (first engrossment)

Sections 1 to 4 allow a brewpub to be issued a license by a municipality for off-sale of malt liquor produced and packaged on the brewpub's premises. Off-sales are limited to the legal hours for off-sale at exclusive liquor stores in the jurisdiction and the malt liquor must be removed from the premises before the applicable off-sale closing time. The malt liquor is required to be sold in 64 ounce sealed containers. Sealing and labeling requirements are specified. Off-sales are limited to no more than 50 percent of the brewer's production or 1,000 barrels, whichever is less.

Section 5 allows the retail licensee delinquent payment list to be posted by the Commissioner the Monday following receipt instead of the day following receipt.

Section 6 allows licenses for the historic Pantages Theatre (S.F. No. 263-Higgins), the American Swedish Institute (S.F. No. 80-Berglin), the Jungle Theater (S.F. No. 922-Berglin), the Guthrie Lab, (S.F. No. 663-Pogemiller) and the Southern Theatre (S.F. No. 1134-Pogemiller).

Section 7 excludes restaurants, certain theater licenses, hotel, and bowling center licenses from the restrictions on the number of on-sale intoxicating liquor licenses that may be issued by a city.

Section 8 authorizes the distribution of free samples and promotional items at on-sale licensees.

Section 9 (S.F. No. 238-Betzold) allows Blaine to issue 15 on-sale intoxicating liquor licenses in addition to the number authorized by law.

Section 10 (S.F. No. 787-Solon) authorizes Duluth to issue one on-sale intoxicating liquor license for the St. Louis County Heritage and Arts Center, commonly known as the Duluth Depot.

Section 11 allows Thief River Falls to issue two on-sale liquor licenses in addition to the number authorized by law.

Section 12 (S.F. No. 720-Marko) authorizes Hastings to issue three on-sale liquor licenses in addition to the number authorized by law.

Section 13 (S.F. No. 358-Limmer) authorizes Maple Grove to issue 12 on-sale liquor licenses in addition to the number authorized by law.

Section 14 (S.F. No. 725-Fischbach) allows Sartell to issue five on-sale liquor licenses in addition to the number authorized by law.

Section 15 (S.F. No. 34-Ourada) allows St. Michael to issue five on-sale liquor licenses in addition to the number authorized by law.

Section 16 (S.F. No. 236-LeClair) allows Woodbury to issue 12 on-sale liquor licenses in addition to the number authorized by law.

Section 17 authorizes Waconia to issue three on-sale liquor licenses in addition to the number authorized by law.

Section 18 (S.F. No. 1147-Pappas) authorizes St. Paul to issue an on-sale liquor license to the Minnesota Centennial Showboat.

Section 19 (S.F. No. 412-Robling) authorizes the city of Elko to issue an on-sale liquor license to the Elko Speedway.

Section 20 (S.F. No. 307-Murphy) allows the city of St. Paul to issue a license to the holder of a State Fair concessions contract authorizing the sale of Minnesota-produced wine by the glass in connection with the sale of food.

Section 21 provides an immediate effective date for purposes of this bill.
