An eligible member is a reservist or National Guard member who was an employee of the state at the time the member was ordered to active service, on or after September 11, 2001. The term "active service" does not include service performed exclusively for training purposes.
Section 2. [May Pay Salary Differential of Reserve on Active Duty.] allows local units of government to pay to each eligible member of the National Guard or other armed forces reservist an amount equal to the difference between the member's basic active duty military salary and the salary the member would be paid as an active political subdivision employee. The section gives a political subdivision discretion regarding employee benefit continuation. The term "active service" excludes service performed exclusively for training purposes.
Section 3. [Effective Date.] makes sections 1 and 2 effective the day following final enactment and applies retroactively to the date an employee was ordered to active service, on or after September 11, 2001.
