This bill adds a subdivision to the education data statute to address issues related to data on nonpublic school students that are reported to the superintendent of the school district in which the child resides. This is in response to advisory opinions of the Commissioner of Administration that the education data statute does not apply to students attending private or nonpublic schools or receiving home-schooling, because the statute only refers to public educational agencies.

The bill specifies that data that must be reported under the statute are private data that may not be designated as directory information without prior written consent of the parent or guardian and may be disclosed only pursuant to certain specific provisions of the education data statute that apply to education data in general.
