S.F. No. 96 -Expansion of Fourth Degree Assault Crime

Section 1 expands the two-year felony fourth-degree assault crime to include the assault of employees or contract service providers of secure facilities for sexual psychopathic personalities while in the line of duty if:

(1) the assault inflicts demonstrable bodily harm; or

(2) the offender intentionally throws or otherwise transfers bodily fluids or feces at or onto a person.

Current law provides a two-year felony penalty for such assaults on correctional employees. This bill expands the crime to include assaults committed on employees or contract service personnel of either a correctional facility or a secure treatment facility for sexual psychopathic personalities.

Section 2 provides an August 1, 2003 effective date, and applies to crimes committed on or after that date.
