A bill for an act
relating to BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:
1.1ARTICLE 7
1.2NUTRITION, LIBRARIES, AND ACCOUNTING

1.3    Section 1. Minnesota Statutes 2012, section 123B.75, subdivision 5, is amended to read:
1.4    Subd. 5. Levy recognition. (a) For fiscal years 2009 and 2010, in June of each
1.5year, the school district must recognize as revenue, in the fund for which the levy was
1.6made, the lesser of:
1.7(1) the sum of May, June, and July school district tax settlement revenue received in
1.8that calendar year, plus general education aid according to section 126C.13, subdivision
1.94
, received in July and August of that calendar year; or
1.10(2) the sum of:
1.11(i) 31 percent of the referendum levy certified according to section 126C.17, in
1.12calendar year 2000; and
1.13(ii) the entire amount of the levy certified in the prior calendar year according to
1.14section 124D.86, subdivision 4, for school districts receiving revenue under sections
1.15124D.86, subdivision 3, clauses (1), (2), and (3); 126C.41, subdivisions 1, 2, paragraph (a),
1.16and 3
, paragraphs (b), (c), and (d); 126C.43, subdivision 2; and 126C.48, subdivision 6; plus
1.17(iii) zero percent of the amount of the levy certified in the prior calendar year for the
1.18school district's general and community service funds, plus or minus auditor's adjustments,
1.19not including the levy portions that are assumed by the state, that remains after subtracting
1.20the referendum levy certified according to section 126C.17 and the amount recognized
1.21according to item (ii).
1.22(b) For fiscal year 2011 and later years, in June of each year, the school district must
1.23recognize as revenue, in the fund for which the levy was made, the lesser of:
1.24(1) the sum of May, June, and July school district tax settlement revenue received in
1.25that calendar year, plus general education aid according to section 126C.13, subdivision
1.264
, received in July and August of that calendar year; or
1.27(2) the sum of:
1.28(i) the greater of 48.6 percent of the referendum levy certified according to section
1.29126C.17 in the prior calendar year, or 31 percent of the referendum levy certified
1.30according to section 126C.17 in calendar year 2000; plus
1.31(ii) the entire amount of the levy certified in the prior calendar year according to
1.32section 124D.4531, 124D.86, subdivision 4, for school districts receiving revenue under
1.33sections 124D.86, subdivision 3, clauses (1), (2), and (3); 124D.862, subdivision 4, for
1.34Special School District No. 1, Minneapolis, Independent School District No. 625, St.
1.35Paul, and Independent School District No. 709, Duluth; 126C.41, subdivisions 1
, 2,
2.1paragraph (a), and 3, paragraphs (b), (c), and (d); 126C.43, subdivision 2; and 126C.48,
2.2subdivision 6; plus
2.3(iii) 48.6 percent of the amount of the levy certified in the prior calendar year for the
2.4school district's general and community service funds, plus or minus auditor's adjustments,
2.5that remains after subtracting the referendum levy certified according to section 126C.17
2.6and the amount recognized according to item (ii).

2.7    Sec. 2. Minnesota Statutes 2012, section 124D.111, subdivision 1, is amended to read:
2.8    Subdivision 1. School lunch aid computation. Each school year, the state must pay
2.9participants in the national school lunch program the amount of 12 14 cents for each full
2.10paid, reduced-price, and free student lunch served to students.
2.11EFFECTIVE DATE.This section is effective July 1, 2013.

2.12    Sec. 3. Minnesota Statutes 2012, section 124D.119, is amended to read:
2.13124D.119 SUMMER FOOD SERVICE REPLACEMENT AID.
2.14States funds are available to compensate department-approved summer food
2.15program sponsors for reduced federal operating reimbursement rates under Public Law
2.16104-193, the federal summer food service program. A sponsor is eligible for summer food
2.17service replacement aid equal to the sum of the following amounts:. Reimbursement shall
2.18be made on December 15 based on total meals served by each sponsor from the end of the
2.19school year to the beginning of the next school year on a pro-rata basis.
2.20(1) for breakfast service, up to four cents per breakfast served by the sponsor during
2.21the current program year;
2.22(2) for lunch or supper service, up to 14 cents per lunch or supper served by the
2.23sponsor during the current program year; and
2.24(3) for supplement service, up to ten cents per supplement served by the sponsor
2.25during the current program year.

2.26    Sec. 4. Minnesota Statutes 2012, section 127A.45, subdivision 2, is amended to read:
2.27    Subd. 2. Definitions. (a) "Other district receipts" means payments by county
2.28treasurers pursuant to section 276.10, apportionments from the school endowment fund
2.29pursuant to section 127A.33, apportionments by the county auditor pursuant to section
2.30127A.34, subdivision 2 , and payments to school districts by the commissioner of revenue
2.31pursuant to chapter 298.
2.32(b) "Cumulative amount guaranteed" means the product of
3.1(1) the cumulative disbursement percentage shown in subdivision 3; times
3.2(2) the sum of
3.3(i) the current year aid payment percentage of the estimated aid and credit
3.4entitlements paid according to subdivision 13; plus
3.5(ii) 100 percent of the entitlements paid according to subdivisions 11 and 12; plus
3.6(iii) the other district receipts.
3.7(c) "Payment date" means the date on which state payments to districts are made
3.8by the electronic funds transfer method. If a payment date falls on a Saturday, a Sunday,
3.9or a weekday which is a legal holiday, the payment shall be made on the immediately
3.10preceding business day. The commissioner may make payments on dates other than
3.11those listed in subdivision 3, but only for portions of payments from any preceding
3.12payment dates which could not be processed by the electronic funds transfer method due
3.13to documented extenuating circumstances.
3.14(d) The current year aid payment percentage equals 73 in fiscal year 2010 and 70
3.15in fiscal year 2011, and 60 in fiscal years 2012 and later 85.5 percent in fiscal year 2014
3.16and later.

3.17    Sec. 5. CYRUS AND MORRIS SCHOOL DISTRICT CONSOLIDATION.
3.18    Subdivision 1. Purpose. The legislature finds that an orderly, voluntary
3.19consolidation of Independent School Districts Nos. 611, Cyrus, and 769, Morris, promotes
3.20the well-being of the students and increases educational efficiency in those school districts.
3.21    Subd. 2. Remediation costs. Independent School District No. 611, Cyrus, may
3.22identify all health and safety remediation costs related to the demolition of the Cyrus
3.23school building and submit those amounts to the commissioner of education for approval.
3.24Any approved costs may be included either in the district's health and safety plan or in the
3.25bonding authority authorized under subdivision 3.
3.26    Subd. 3. Facility bonds. Independent School District No. 611, Cyrus, may issue
3.27general obligation bonds without an election under Minnesota Statutes, chapter 475, after
3.28a public meeting of the school board with notice given by mail according to Minnesota
3.29Statutes, section 123B.09, subdivision 11, in an amount not to exceed $1,000,000
3.30approved by the commissioner of education for the costs associated with demolishing the
3.31Cyrus school building. The bonds must be repaid within ten years of issuance. Any excess
3.32bond proceeds after bonds are repaid, must be credited back to the taxpayers of the former
3.33Independent School District No. 611, Cyrus.
3.34    Subd. 4. Reorganization operating debt determined. Independent School District
3.35No. 611, Cyrus, must estimate its reorganization operating debt according to Minnesota
4.1Statutes, section 123B.82, and submit that amount to the commissioner of education
4.2for approval.
4.3    Subd. 5. Reorganization operating debt bonds. Independent School District No.
4.4611, Cyrus, may issue general obligation bonds without an election under Minnesota
4.5Statutes, chapter 475, after a public meeting of the school board with notice given by mail
4.6according to Minnesota Statutes, section 123B.09, subdivision 11, in an amount not to
4.7exceed the reorganization operating debt approved by the commissioner of education
4.8under subdivision 4. The bonds must be repaid within six years of issuance.
4.9    Subd. 6. Repayment. The bonded debt issued under this section remains payable
4.10by the taxable property located within the boundaries of former Independent School
4.11District No. 611, Cyrus.
4.12EFFECTIVE DATE.This section is effective the day following final enactment.

4.13    Sec. 6. RECIPROCITY AGREEMENT EXEMPTION; HENDRICKS.
4.14Notwithstanding Minnesota Statutes, sections 124D.04, subdivision 6, paragraph
4.15(b); 124D.041, subdivision 3, paragraph (b); and 124D.05, subdivision 2a, the provisions
4.16of Minnesota Statutes, section 124D.041 and the agreement shall not apply to Independent
4.17School District No. 402, Hendricks.
4.18EFFECTIVE DATE.This section is effective for the 2013-2014 school year and
4.19later.

4.20    Sec. 7. APPROPRIATIONS.
4.21    Subdivision 1. Department of Education. The sums indicated in this section are
4.22appropriated from the general fund to the Department of Education for the fiscal years
4.23designated.
4.24    Subd. 2. School lunch. For school lunch aid according to Minnesota Statutes,
4.25section 124D.111, and Code of Federal Regulations, title 7, section 210.17:
