4.31LANDS.
4.32    Subdivision 1. Easements. (a) Authority. Except where the authority conferred
4.33by this section has been imposed on some other state or county office, the commissioner
4.34may grant an easement or permit over, under, or across any land owned by the state for
4.35the purpose of constructing roads, streets, telephone, telegraph, and electric power lines,
5.1cables or conduits, underground or otherwise, or mains or pipe lines for gas, liquids, or
5.2solids in suspension public purposes, including but not limited to, access, road, street,
5.3mass transit, telecommunication, flood protection, or utility purposes. This authority
5.4does not apply to land under the jurisdiction of the commissioner of natural resources or
5.5land obtained for trunk highway purposes.
5.6(b) Notice of revocation. An easement or permit is revocable by written notice
5.7given by the commissioner if at any time its continuance will conflict with a public use
5.8of the land over, under, or upon which it is granted, or for any other reason. The notice
5.9must be in writing and is effective 90 days after the notice is sent by certified mail to the
5.10last known address of the record holder of the easement. If the address of the holder of
5.11the easement or permit is not known, it expires 90 days after the notice is recorded in the
5.12office of the county recorder of the county in which the land is located. Upon revocation
5.13of an easement, the commissioner may allow a reasonable time for the easement holder
5.14to vacate the premises affected. Notwithstanding the foregoing, the commissioner may
5.15grant to a state agency or political subdivision a permanent easement for the construction,
5.16operation, and maintenance of publicly owned infrastructure as described in paragraph (a),
5.17to have and to hold for as long as the easement area is used in accordance with the terms
5.18and conditions of the easement. If a permanent easement ceases to be used for the purposes
5.19stated in the easement or in accordance with its terms and conditions, the easement may be
5.20revoked by a written notice given by the commissioner in accordance with this paragraph.
5.21(c) Easement runs with land. State land subject to an easement or permit granted
5.22by the commissioner remains subject to sale or lease, and the sale or lease does not revoke
5.23the permit or easement granted.
5.24    Subd. 2. Land controlled by other agencies. If the easement or permit involves
5.25land under the jurisdiction of an agency other than the Department of Administration, it
5.26is subject to the approval of the head of the agency and is subject to revocation by the
5.27commissioner as provided in this section, on request of the head of the agency.
5.28    Subd. 3. Application. An application for easement or permit under this section
5.29must be in quadruplicate and must include: a legal description of the land affected; a
5.30map showing the area affected by the easement or permit; and a detailed design of any
5.31structures to be placed on the land. The commissioner may require that the application
5.32be in another form and include other descriptions, maps, or designs. The commissioner
5.33may at any time order changes or modifications respecting construction or maintenance of
5.34structures or other conditions of the easement which the commissioner finds necessary to
5.35protect the public health and safety.
6.1    Subd. 4. Form; duration. The easement or permit must be in a form prescribed
6.2by the attorney general and must describe the location of the easement granted. The
6.3easement or permit continues until revoked by the commissioner, subject to change or
6.4modification as provided in this section.
6.5    Subd. 5. Consideration; terms. The commissioner may prescribe consideration
6.6and conditions for granting an easement or permit. Money received by the state under
6.7this section must be credited to the fund to which income or proceeds of sale from the
6.8land would be credited, if provision for the sale is made by law. Otherwise, it must be
6.9credited to the general fund."

6.12WASTE FROM STATE BUILDINGS; REQUIREMENT.
6.13The commissioner shall require in contracts for the construction, renovation, or
6.14demolition of a state building that the contractor and any subcontractor must divert from
6.15deposit in a landfill and must recycle at least 50 percent of the nonhazardous construction
6.16and demolition waste, measured by tonnage or volume, produced by the project or
6.17demonstrate that the waste was delivered to construction and demolition waste recycling
6.18facilities that maintain a 50 percent annual recycling rate. This requirement applies to a
6.19project to construct, renovate, or demolish a state building that receives funding from the
6.20bond proceeds fund after January 1, 2011, provided that:
6.21(1) the project is located within 40 miles of a construction and demolition waste
6.22recycling facility that meets the requirements of this section and can process the applicable
6.23building materials; and
6.24(2) for construction and renovation projects, funding from the bond proceeds fund is
6.25$5,000,000 or more.
6.26 For the purposes of this section, "state building" means a building wholly owned or
6.27leased by a state agency, the Minnesota State Colleges and Universities, or the University
6.28of Minnesota."
